In this paper, I endorse the idea that age is a defensible criterion for eligibility to vote, where age is itself a proxy for having a broad set of cognitive and motivational capacities. Given the current (and defeasible) state of developmental research, I suggest that the age of 16 is a good proxy for such capacities. In defending this thesis, I consider alternative and narrower capacity conditions while drawing on insights from a parallel debate about capacities and age requirements in (...) the criminal law. I also argue that the expansive capacity condition I adopt satisfies a number of powerful and complementary rationales for voting eligibility, and conclude by addressing challenging arguments that, on the one hand, capacity should not underlie voting eligibility in the first place, and, on the other, that capacity should do so directly and not via any sort of proxy, including age. This essay explores a conception of responsibility at work in moral and criminal responsibility. Our conception draws on work in the compatibilist tradition that focuses on the choices of agents who are reasons-responsive and work in criminal jurisprudence that understands responsibility in terms of the choices of agents who have capacities for practical reason and whose situation affords them the fair opportunity to avoid wrongdoing. Our conception brings together the dimensions of normative competence and situational control, and we factor normative (...) competence into cognitive and volitional capacities, which we treat as equally important to normative competence and responsibility. Normative competence and situational control can and should be understood as expressing a common concern that blame and punishment presuppose that the agent had a fair opportunity to avoid wrongdoing. This fair opportunity is the umbrella concept in our understanding of responsibility, one that explains it distinctive architecture. (shrink)

An agent is morally competent if she can respond to moral considerations. There is a debate about whether agents are open to moral blame only if they are morally competent, and Dana Nelkin’s “Psychopaths, Incorrigible Racists, and the Faces of Responsibility” is an important contribution to this debate. Like others involved in this dispute, Nelkin takes the case of the psychopath to be instructive. This is because psychopaths are similar to responsible agents insofar as they act deliberately (...) and on judgments about reasons, and yet psychopaths lack moral competence. Nelkin argues that, because of their moral incompetence, vices such as cruelty are not attributable to psychopaths. It follows that psychopaths are not open to moral blame since their behavior is only seemingly vicious. I have three aims in this reply to Nelkin. First, I respond to her claim that psychopaths are not capable of cruelty. Second, I respond to the related proposal—embedded in Nelkin’s “symmetry argument”—that a “pro-social psychopath” would not be capable of kindness. My responses to these claims are unified: even if the psychopath is not capable of “cruelty,” and the pro-social psychopath is not capable of “kindness,” the actions of these agents can have a significance for us that properly engages our blaming and praising practices. Finally, I argue that Nelkin’s strategy for showing that moral competence is required for cruelty supports a stronger conclusion than she anticipates: it supports the conclusion that blameworthiness requires not just moral competence, but actual moral understanding. In The Second Sex, Simone de Beauvoir diagnoses “woman” as the “lost sex,” torn between her individual autonomy and her “feminine destiny.” Becoming a “real woman” in patriarchal societies demands that women lose their authentic, autonomous selves to become the “inessential Other” for Man. To better understand this diagnosis and how women might refind themselves, I rehabilitate the influence of Søren Kierkegaard and his concept of repetition as what must be lost to be found again in Beauvoir’s account of freedom (...) and, specifically, the liberation of women. Beauvoir offers a dual account of repetition, that of mundane repetition and sacrificial repetition, bringing them to bear both on her diagnosis of women’s oppression and her theorization of our liberation. Sacrificial repetition becomes a temporality for freedom—one must be able to repeat or retake their autonomy continuously toward an open future. For this to happen concretely, Beauvoir insists that we must sacrifice the (racist, classist) patriarchal ideals of the “real woman” and “real man” as we retake our autonomy and reconfigure the meaning of sex difference anew. Hannah Arendt's rich and varied political thought is more influential today than ever before, due in part to the collapse of communism and the need for ideas that move beyond the old ideologies of the Cold War. As Dana Villa shows, however, Arendt's thought is often poorly understood, both because of its complexity and because her fame has made it easy for critics to write about what she is reputed to have said rather than what she actually wrote. Villa (...) sets out to change that here, explaining clearly, carefully, and forcefully Arendt's major contributions to our understanding of politics, modernity, and the nature of political evil in our century.Villa begins by focusing on some of the most controversial aspects of Arendt's political thought. He shows that Arendt's famous idea of the banality of evil--inspired by the trial of Adolf Eichmann--does not, as some have maintained, lessen the guilt of war criminals by suggesting that they are mere cogs in a bureaucratic machine. He examines what she meant when she wrote that terror was the essence of totalitarianism, explaining that she believed Nazi and Soviet terror served above all to reinforce the totalitarian idea that humans are expendable units, subordinate to the all-determining laws of Nature or History. Villa clarifies the personal and philosophical relationship between Arendt and Heidegger, showing how her work drew on his thought while providing a firm repudiation of Heidegger's political idiocy under the Nazis. Less controversially, but as importantly, Villa also engages with Arendt's ideas about the relationship between political thought and political action. He explores her views about the roles of theatricality, philosophical reflection, and public-spiritedness in political life. And he explores what relationship, if any, Arendt saw between totalitarianism and the "great tradition" of Western political thought. Throughout, Villa shows how Arendt's ideas illuminate contemporary debates about the nature of modernity and democracy and how they deepen our understanding of philosophers ranging from Socrates and Plato to Habermas and Leo Strauss.Direct, lucid, and powerfully argued, this is a much-needed analysis of the central ideas of one of the most influential political theorists of the twentieth century. Background: Current practice frequently fails to provide care consistent with the preferences of decisionally-incapacitated patients. It also imposes significant emotional burden on their surrogates. Algorithmic-based patient preference predictors (PPPs) have been proposed as a possible way to address these two concerns. While previous research found that patients strongly support the use of PPPs, the views of surrogates are unknown. The present study thus assessed the views of experienced surrogates regarding the possible use of PPPs as a means to help make (...) treatment decisions for decisionally-incapacitated patients. -/- Methods: This qualitative study used semi-structured interviews to determine the views of experienced surrogates [n=26] who were identified from two academic medical centers and two community hospitals. The primary outcomes were respondents’ overall level of support for the idea of using PPPs and the themes related to their views on how a PPP should be used, if at all, in practice. -/- Results: Overall, 21 participants supported the idea of using PPPs. The remaining five indicated that they would not use a PPP because they made decisions based on the patient’s best interests, not based on substituted judgment. Major themes which emerged were that surrogates, not the patient’s preferences, should determine how treatment decisions are made, and concern that PPPs might be used to deny expensive care or be biased against minority groups. -/- Conclusions: Surrogates, like patients, strongly support the idea of using PPPs to help make treatment decisions for decisionally-incapacitated patients. These findings provide support for developing a PPP and assessing it in practice. At the same time, patients and surrogates disagree over whose preferences should determine how treatment decisions are made, including whether to use a PPP. These findings reveal a fundamental disagreement regarding the guiding principles for surrogate decision-making. Future research is needed to assess this disagreement and consider ways to address it. We often find ourselves in situations where it is up to us to make decisions on behalf of others. How can we determine whether such decisions are morally justified, especially if those decisions may change who it is these others end up becoming? In this paper, I will evaluate one plausible kind of justification that may tempt us: we may want to justify our decision by appealing to the likelihood that the other person will be glad we made that specific (...) choice down the line. Although it is tempting, I ultimately argue that we should reject this sort of appeal as a plausible justification for the moral permissibility of our vicarious decisions. This is because the decisions that we make on behalf of another may affect the interests and values that that person will hold in the future. As I will show, this complicates the justificatory relationship between present decisions and future attitudes, since the latter can depend on the former. This is not to say that the predicted future attitudes of others can play no significant role in justifying our decisions on others’ behalf. Rather, appealing to the future attitudes in our moral justifications may play an important role in our practical thinking but only when we consider the future attitudes of all relevant possible futures. ABSTRACT This paper argues for a version of sceptical invariantism about knowledge on which the acceptability of knowledge-attributing sentences varies with the context of assessment.

When people are making certain medical decisions – especially potentially transformative ones – the specter of regret may color their choices. In this paper, I ask: can predicting that we will regret a decision in the future serve any justificatory role in our present decision-making? And if so, what role? While there are many pitfalls to such reasoning, I ultimately conclude that considering future retrospective emotions like regret in our decisionmaking can be both rational and authentic. Rather than indicating that (...) one is about to make a mistake or that there is some underlying value that one already cares about but is overlooking, the prediction that one will regret a decision in the future makes one confront how her present values and priorities may change as a result of her choice in ways she cannot presently anticipate. Abstract: This research paper presents a novel approach to predict audit risks using a neural network model. The dataset used for this study was obtained from Kaggle and comprises 774 samples with 18 features, including Sector_score, PARA_A, SCORE_A, PARA_B, SCORE_B, TOTAL, numbers, marks, Money_Value, District, Loss, Loss_SCORE, History, History_score, score, and Risk. The proposed neural network architecture consists of three layers, including one input layer, one hidden layer, and one output layer. The neural network model was trained and validated, achieving (...) an impressive accuracy of 100% and an average error of 0.000015, indicating its robust predictive capability. Moreover, we conducted feature importance analysis to identify the most influential features for predicting audit risk. The key features found to be critical for classifying fraudulent activities in audit risk prediction are Sector_score, PARA_A, SCORE_A, PARA_B, SCORE_B, TOTAL, numbers, marks, Money_Value, District, Loss, Loss_SCORE, History, and History_score. This research contributes to the field of audit risk prediction by demonstrating the effectiveness of a neural network-based approach and highlighting the importance of specific features in detecting fraudulent activities. The findings have significant implications for auditors and organizations seeking to enhance their audit risk assessment processes, ultimately leading to improved financial transparency and fraud detection. Democratizing the syllabus has been discussed in the fields of sociology and political science but rarely in philosophy. In this paper I will draw upon my experience of teaching Philosophy of Love in an online modality to examine the impact on motivation when students fill in the gaps presented in a democratic syllabus.

Many people view disabilities as misfortunes, call this the standard view. In this paper, I examine one criticism that has been launched against the Standard View. Rather than determine in advance whether having a disability is good or bad for a person, some critics argue that the Standard View is reflective of and brings about inappropriate emotional responses toward people with disabilities and their circumstances. For instance, philosophers have recently argued that in holding the standard view, we become prone to (...) a destructive kind of unwarranted pity or that the view leads us to hold certain untenable or inappropriate hopes for our children and for our society. I think this sort of challenge to the Standard View has a lot of appeal, but I worry that if it is not properly articulated, the approach is vulnerable to what has been known as “The Wrong Kind of Reason” problem. Abstract: Each affective state has distinct motor-expressions, sensory perceptions, autonomic, and cognitive patterns. Panksepp (1998) proposed seven neural affective systems of which the SEEKING system, a generalized approach-seeking system, motivates organisms to pursue resources needed for survival. When an organism is presented with a novel stimulus, the dopamine (DA) in the nucleus accumbens septi (NAS) is released. The DA circuit outlines the generalized mesolimbic dopamine-centered SEEKING system and is especially responsive when there is an element of unpredictability in forthcoming rewards. (...) We propose that when the outcome of this interaction is unexpected or unanticipated then Panksepp’s “cognitive or expectancy reset” mechanism involving the cognitive dissonance would yield the subjective emotion of surprise. In order to appropriately react to the environment’s stimuli one needs fundamental processes that would enable one to distinguish between what is novel and what has been already experienced, as well as the different degrees of novelty. Novel events are those whose essential features of the representation (visceral and perceptual) are altered and being discrepant provoke more sustained attention. Novelty arises from salient and arousing events and the organism experiences surprise, as coming out of a habitual state. In this framework, we shall look at established theories of emotions and propose a different approach to their taxonomy. (shrink)

Socrates engages his audience in Phaedrus with speeches that include revised or newly composed myths that express his theory of philosophical eros. The aim of the speeches is to generate a love for truth that spills over into dialogue. Speeches are a starting point for dialogue, just like physical attraction is the beginning of love. In the case of Phaedrus, the beginning of philosophy is portrayed using playful and rhetorically rich speeches that serve as "love potions" awakening the novice's soul, (...) and ultimately leading Phaedrus to higher rungs on the ladder of love through the palinode, a medicinal speech. It is thinking about speeches, not the speeches themselves, which moves Socrates' student Phaedrus from the love of speeches to the love of Beauty itself. This is a stark contrast to the purpose of speechmaking for the sophist. The sophist seeks to enchant the soul, while the philosopher seeks to charm the soul into loving wisdom through stimulating discussions. Socrates also uses role reversals in the lover-beloved relationship to model the soul's ascent, contrasting the traditional roles with the way the lover and beloved are presented in Socrates' speeches. The novice must actively recollect Beauty itself in order to ascend, rather than passively listening to speeches that provide an image of beauty. Socrates' interlocutors must move themselves up the ladder of love from their own philosophical eros; wisdom is not attained by merely being pushed all the way up the ladder of love. (shrink)

This paper considers the responsibilities of the FDA with regard to disseminating information about the benefits and harms of e-cigarettes. Tobacco harm reduction advocates claim that the FDA has been overcautious and has violated ethical obligations by failing to clearly communicate to the public that e-cigarettes are far less harmful than cigarettes. We argue, by contrast, that the FDA’s obligations in this arena are more complex than they may appear at first blush. Though the FDA is accountable for informing the (...) public about the health risks and benefits of products it regulates, it also has other roles that inform when and how it should disseminate information. In addition to being a knowledge purveyor, it is also a knowledge producer, an advisor to the public, and a practical agent shaping the material conditions in which people make health-related choices. In our view, those other roles call for caution in the way the FDA interprets and communicates the available evidence. (shrink)

Recently, bioethicists and the UNCRPD have advocated for supported medical decision-making on behalf of patients with intellectual disabilities. But what does supported decision-making really entail? One compelling framework is Anita Silvers and Leslie Francis’ mental prosthesis account, which envisions supported decision-making as a process in which trustees act as mere appendages for the patient’s will; the trustee provides the cognitive tools the patient requires to realize her conception of her own good. We argue that supported decision-making would be better understood (...) as a collaborative process, giving patients with intellectual disabilities the opportunity to make decisions in a respectful relationship with trusted others. We offer an alternative account of supported decision-making where the primary constraint is to protect the patient from domination by the trustee. This is advantageous in its preservation of the prospects for genuine collaboration, for the mental prosthesis approach ultimately reinforces a problematic ideal of isolated patient self-determination. The aesthetics of body and dress are in a continuous flux. The body, being the locus where fashion challenges the traditional norms, escapes from the narrow boundaries of the conventionally beautiful; the disgusting soma, in the realm of Negative Aesthetics, takes its place. In this paper, I attempt to define what is disgusting fashion and how can contribute to the deliberation of the body from the restricting margins of the aesthetically beautiful. The distorted imagery of the feminine soma is the (...) center of the analysis of the non-beautiful as an aesthetically pleasing phenomenon. Different examples of repulsive clothing are analyzed from a philosophical point of view, in order to understand the relation between the negative emotional responses towards disgusting fashion and its aesthetic value. -/- . The problem of synthetic judgements touches on the question of whether philosophy can draw independent statements about reality in the first place. For Kant, the synthetic judgements a priori formulate the conditions of the possibility for objectively valid knowledge. Despite the principle fallibility of its statements, modern science aims for objective knowledge. This gives the topic of synthetic a priori unbroken currency. This paper aims to show that a modernized version of transcendental philosophy, if it is to be feasible at (...) all, must “bid farewell” to the concept of being “free of empiricism” or the “purity” of the a priori. Approaches to this end can already been found in Kant’s reflections on non-pure synthetic knowledge. Moreover, the a priori validity of knowledge does not exclude the possibility that it can be discovered empirically. In keeping with Kant, Fries and Nelson anticipated this separation (usually first attributed to Reichenbach) between the validity and discovery context of knowledge and pointed out that the a priori could be discovered empirically, but never proven. There are currently still good reasons why transcendental philosophical concepts are of fundamental importance for modern science, although it must not be overlooked that even within the framework of a modernized transcendental philosophy, several unsolved problems remain or are raised. For example, the irredeemability of the universal validity and necessary claims of the a priori, the problem of a clear demarcation between the phenomenal and noumenal world. Moreover, the “beautiful structure” or the Kantian system, which constituted its persuasive power, is lost. (shrink)

Indigenous people (IP) have faced multiple difficulties in education. Indigenous students often do worse academically than non-indigenous student peers. These stated the low enrollment rates showed a dropout rate, absenteeism, repetition rates, literacy rate, and thus the educational outcomes, with retention and completion being two significant issues. Further, this study explores the lived experiences and challenges faced by indigenous high school students amidst the new normal education. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) The reason (...) why IP learners were not satisfied with their performance is that they cannot understand some of the lessons due to the language barrier. (2) IP learners are committed to finishing their studies, however, some of the students lack resources for studying, like gadgets for researching, and they do not have cell phones. And the other students may have gadgets or cellphones, but their internet connection is low or not accessible in some places at their location. (shrink)

Jenenser magazine for critical thinking. 6th of November 1994 edition -/- 1. Biography -/- Jakob Friedrich Fries was born on the 23rd of August, 1773 in Barby on the Elbe. Because Fries' father had little time, on account of his journeying, he gave up both his sons, of whom Jakob Friedrich was the elder, to the Herrnhut Teaching (...) Institution in Niesky in 1778. Fries attended the theological seminar in Niesky in autumn 1792, which lasted for three years. There he (secretly) began to study Kant. The reading of Kant's works led Fries, for the first time, to a deep philosophical satisfaction. His enthusiasm for Kant is to be understood against the background that a considerable measure of Kant's philosophy is based on a firm foundation of what happens in an analogous and similar manner in mathematics. -/- During this period he also read Heinrich Jacobi's novels, as well as works of the awakening classic German literature; in particular Friedrich Schiller's works. In 1795, Fries arrived at Leipzig University to study law. During his time in Leipzig he became acquainted with Fichte's philosophy. In autumn of the same year he moved to Jena to hear Fichte at first hand, but was soon disappointed. -/- During his first sojourn in Jenaer (1796), Fries got to know the chemist A. N. Scherer who was very influenced by the work of the chemist A. L. Lavoisier. Fries discovered, at Scherer's suggestion, the law of stoichiometric composition. Because he felt that his work still need some time before completion, he withdrew as a private tutor to Zofingen (in Switzerland). There Fries worked on his main critical work, and studied Newton's "Philosophiae naturalis principia mathematica". He remained a lifelong admirer of Newton, whom he praised as a perfectionist of astronomy. Fries saw the final aim of his mathematical natural philosophy in the union of Newton's Principia with Kant's philosophy. -/- With the aim of qualifying as a lecturer, he returned to Jena in 1800. Now Fries was known from his independent writings, such as "Reinhold, Fichte and Schelling" (1st edition in 1803), and "Systems of Philosophy as an Evident Science" (1804). The relationship between G. W. F. Hegel and Fries did not develop favourably. Hegel speaks of "the leader of the superficial army", and at other places he expresses: "he is an extremely narrow-minded bragger". On the other hand, Fries also has an unfavourable take on Hegel. He writes of the "Redundancy of the Hegelistic dialectic" (1828). In his History of Philosophy (1837/40) he writes of Hegel, amongst other things: "Your way of philosophising seems just to give expression to nonsense in the shortest possible way". In this work, Fries appears to argue with Hegel in an objective manner, and expresses a positive attitude to his work. -/- In 1805, Fries was appointed professor for philosophy in Heidelberg. In his time spent in Heidelberg, he married Caroline Erdmann. He also sealed his friendships with W. M. L. de Wette and F. H. Jacobi. Jacobi was amongst the contemporaries who most impressed Fries during this period. In Heidelberg, Fries wrote, amongst other things, his three-volume main work New Critique of Reason (1807). -/- In 1816 Fries returned to Jena. When in 1817 the Wartburg festival took place, Fries was among the guests, and made a small speech. 1819 was the so-called "Great Year" for Fries: His wife Caroline died, and Karl Sand, a member of a student fraternity, and one of Fries' former students stabbed the author August von Kotzebue to death. Fries was punished with a philosophy teaching ban but still received a professorship for physics and mathematics. Only after a period of years, and under restrictions, he was again allowed to read philosophy. From now on, Fries was excluded from political influence. The rest of his life he devoted himself once again to philosophical and natural studies. During this period, he wrote "Mathematical Natural Philosophy" (1822) and the "History of Philosophy" (1837/40). -/- Fries suffered from a stroke on New Year's Day 1843, and a second stroke, on the 10th of August 1843 ended his life. -/- 2. Fries' Work Fries left an extensive body of work. A look at the subject areas he worked on makes us aware of the universality of his thinking. Amongst these subjects are: Psychic anthropology, psychology, pure philosophy, logic, metaphysics, ethics, politics, religious philosophy, aesthetics, natural philosophy, mathematics, physics and medical subjects, to which, e.g., the text "Regarding the optical centre in the eye together with general remarks about the theory of seeing" (1839) bear witness. With popular philosophical writings like the novel "Julius and Evagoras" (1822), or the arabesque "Longing, and a Trip to the Middle of Nowhere" (1820), he tried to make his philosophy accessible to a broader public. Anthropological considerations are shown in the methodical basis of his philosophy, and to this end, he provides the following didactic instruction for the study of his work: "If somebody wishes to study philosophy on the basis of this guide, I would recommend that after studying natural philosophy, a strict study of logic should follow in order to peruse metaphysics and its applied teachings more rapidly, followed by a strict study of criticism, followed once again by a return to an even closer study of metaphysics and its applied teachings." -/- 3. Continuation of Fries' work through the Friesian School -/- Fries' ideas found general acceptance amongst scientists and mathematicians. A large part of the followers of the "Fries School of Thought" had a scientific or mathematical background. Amongst them were biologist Matthias Jakob Schleiden, mathematics and science specialist philosopher Ernst Friedrich Apelt, the zoologist Oscar Schmidt, and the mathematician Oscar Xavier Schlömilch. Between the years 1847 and 1849, the treatises of the "Fries School of Thought", with which the publishers aimed to pursue philosophy according to the model of the natural sciences appeared. In the Kant-Fries philosophy, they saw the realisation of this ideal. The history of the "New Fries School of Thought" began in 1903. It was in this year that the philosopher Leonard Nelson gathered together a small discussion circle in Goettingen. Amongst the founding members of this circle were: A. Rüstow, C. Brinkmann and H. Goesch. In 1904 L. Nelson, A. Rüstow, H. Goesch and the student W. Mecklenburg travelled to Thuringia to find the missing Fries writings. In the same year, G. Hessenberg, K. Kaiser and Nelson published the first pamphlet from their first volume of the "Treatises of the Fries School of Thought, New Edition". -/- The school set out with the aim of searching for the missing Fries' texts, and re-publishing them with a view to re-opening discussion of Fries' brand of philosophy. The members of the circle met regularly for discussions. Additionally, larger conferences took place, mostly during the holidays. Featuring as speakers were: Otto Apelt, Otto Berg, Paul Bernays, G. Fraenkel, K. Grelling, G. Hessenberg, A. Kronfeld, O. Meyerhof, L. Nelson and R. Otto. On the 1st of March 1913, the Jakob-Friedrich-Fries society was founded. Whilst the Fries' school of thought dealt in continuum with the advancement of the Kant-Fries philosophy, the members of the Jakob-Friedrich-Fries society's main task was the dissemination of the Fries' school publications. In May/June, 1914, the organisations took part in their last common conference before the gulf created by the outbreak of the First World War. Several members died during the war. Others returned disabled. The next conference took place in 1919. A second conference followed in 1921. Nevertheless, such intensive work as had been undertaken between 1903 and 1914 was no longer possible. -/- Leonard Nelson died in October 1927. In the 1930's, the 6th and final volume of "Treatises of the Fries School of Thought, New Edition" was published. Franz Oppenheimer, Otto Meyerhof, Minna Specht and Grete Hermann were involved in their publication. -/- 4. About Mathematical Natural Philosophy -/- In 1822, Fries' "Mathematical Natural Philosophy" appeared. Fries rejects the speculative natural philosophy of his time - above all Schelling's natural philosophy. A natural study, founded on speculative philosophy, ceases with its collection, arrangement and order of well-known facts. Only a mathematical natural philosophy can deliver the necessary explanatory reasoning. The basic dictum of his mathematical natural philosophy is: "All natural theories must be definable using purely mathematically determinable reasons of explanation." Fries is of the opinion that science can attain completeness only by the subordination of the empirical facts to the metaphysical categories and mathematical laws. -/- The crux of Fries' natural philosophy is the thought that mathematics must be made fertile for use by the natural sciences. However, pure mathematics displays solely empty abstraction. To be able to apply them to the sensory world, an intermediatory connection is required. Mathematics must be connected to metaphysics. The pure mechanics, consisting of three parts are these: a) A study of geometrical movement, which considers solely the direction of the movement, b) A study of kinematics, which considers velocity in Addition, c) A study of dynamic movement, which also incorporates mass and power, as well as direction and velocity. -/- Of great interest is Fries' natural philosophy in view of its methodology, particularly with regard to the doctrine "leading maxims". Fries calls these "leading maxims" "heuristic", "because they are principal rules for scientific invention". -/- Fries' philosophy found great recognition with Carl Friedrich Gauss, amongst others. Fries asked for Gauss's opinion on his work "An Attempt at a Criticism based on the Principles of the Probability Calculus" (1842). Gauss also provided his opinions on "Mathematical Natural Philosophy" (1822) and on Fries' "History of Philosophy". Gauss acknowledged Fries' philosophy and wrote in a letter to Fries: "I have always had a great predilection for philosophical speculation, and now I am all the more happy to have a reliable teacher in you in the study of the destinies of science, from the most ancient up to the latest times, as I have not always found the desired satisfaction in my own reading of the writings of some of the philosophers. In particular, the writings of several famous (maybe better, so-called famous) philosophers who have appeared since Kant have reminded me of the sieve of a goat-milker, or to use a modern image instead of an old-fashioned one, of Münchhausen's plait, with which he pulled himself from out of the water. These amateurs would not dare make such a confession before their Masters; it would not happen were they were to consider the case upon its merits. I have often regretted not living in your locality, so as to be able to glean much pleasurable entertainment from philosophical verbal discourse." -/- The starting point of the new adoption of Fries was Nelson's article "The critical method and the relation of psychology to philosophy" (1904). Nelson dedicates special attention to Fries' re-interpretation of Kant's deduction concept. Fries awards Kant's criticism the rationale of anthropological idiom, in that he is guided by the idea that one can examine in a psychological way which knowledge we have "a priori", and how this is created, so that we can therefore recognise our own knowledge "a priori" in an empirical way. Fries understands deduction to mean an "awareness residing darkly in us is, and only open to basic metaphysical principles through conscious reflection.". -/- Nelson has pointed to an analogy between Fries' deduction and modern metamathematics. In the same manner, as with the anthropological deduction of the content of the critical investigation into the metaphysical object show, the content of mathematics become, in David Hilbert's view, the object of metamathematics. -/-. Concentration of the world’s wealth in the hands of a few, corporate owners as heads of state – these are facts that lend plausibility to Marx' pronouncements. Yet, how should we evaluate his ideas from today’s vantage point?

Economic pressures, mounting environmental, security and health requirements, are all critical factors that shape economic action. With regard to environmental protection, an economic entity acting as homo oeconomicus finds himself in a situation resembling a prisoner’s dilemma. Signposts for a possible resolution of this dilemma include an environmental management system, a system of environmental law based on the principles of environmental ethics, and a new conception of human nature.

Nelson's Proof of the Impossibility of the Theory of Knowledge -/- In addressing the possibility of a theory of knowledge, Leonard Nelson noted the contradiction of an epistemological criterion that one would require in order to differentiate between valid and invalid knowledge. Nelson concluded that the inconsistency of such a criterion proves the impossibility of the theory of knowledge. -/- Had the epistemological criterion had a perception, then it would presume to adjudicate on its own truth (thus epistemological circular argument). (...) However, if one were to assume that the criterion is not knowledge, one would then have to justify how this is a criterion for truth - yet this would only be possible when it may be considered as an object of knowledge. One would equally have had to predetermine the criterion in order to determine the truth of this knowledge, thereby providing another circular argument. Ostensibly, every criterion of truth fails at its very own test since it cannot guarantee its own truth, just as Munchausen, contrary to his assertion, could not draw himself out of the swamp by tugging on a tuft of his own hair. -/- Nelson proposed a solution of the epistemological problem (the question of the differentiation between valid and invalid knowledge), that based on Jakob Friedrich Fries' differentiation between proof and deduction. Proof, according to Nelson (in reference to Fries), can be defined as derivation of truth from one statement from another statement. Thus, from the truth in the statement that "all men are mortal", one is then able to say that "Socrates is a man" and thence extrapolate from the truth of the statement that "Socrates is mortal." If knowledge were to be considered somewhat judgmental (in a statement), then an attempt at proof (i.e. recourse to previous judgments) would inevitably lead to an infinite regression in justification, since each judgment would necessitate a further justification from another judgment. Every attempt to prove an epistemological criterion is thus also confronted by this regression in justification. -/- Nelson's attempt at a solution rests on the assumption of the existence of an immediate knowledge as a justification of the truth (mediate) of knowledge. Nelson considers immediate knowledge to be non-judgmental knowledge. These include intuitions (e. g. seeing-the-red-roof) and also philosophical knowledge that pre-exists in his opinion before a judgmental reflexion (immediate) in our reason (e. g. the principle of causality). -/- Proof of the truth of mediate knowledge can be effected by showing its compliance with attendant immediate knowledge (rational truth = correspondence of mediate knowledge with their immediate knowledge). Nelson considered this as a resolution of the circular epistemological argument. In regard to philosophical knowledge, Nelson sees these as subject to deduction and not proof. Naturwissenschaften, Mathematik und Logik waren für Nelson von zentraler Bedeutung. Er pflegte bereits als Jugendlicher intensive Kontakte zu Naturwissenschaftlern und Mathematikern. Dadurch erhielt er Anregungen, die von Anfang an seine philosophischen Ansätze beeinflussten. Inspiriert von der Kant-Fries’schen Philosophie und der Axiomatik der Mathematik, konzipierte Nelson seine Philosophie als exakte Wissenschaft. Wie Kant und Fries betrachtete Nelson die Suche nach den allgemeinen Prinzipien der Naturwissenschaften als Hauptaufgabe der Naturphilosophie. Ergebnis dieser kritischen Analyse ist ein System von metaphysischen Grundsätzen der Naturwissenschaft. Nelson (...) übernimmt Kants Lehre von den Grundsätzen des reinen Verstandes. Keine empirisch gefundene Gesetzmäßigkeit könne diesen Grundsätzen widersprechen. Für die Gesetze der Newton’schen Mechanik hätten, so meint Nelson, Kant und Fries diesen Nachweis erbracht. Deshalb formulierte Nelson das sogenannte Postulat der Mechanistik, gemäß dem alle Naturerscheinungen auf mechanische Vorgänge zurückgeführt werden können. Das starre Festhalten an diesem Postulat veranlasste ihn zur Ablehnung bedeutsamer physikalischer Konzeptionen (z. B. des auf der Elektrodynamik basierenden Relativitätsprinzips, des Nahwirkungskonzepts und des Atommodells). Das „Relativitätsprinzip der Elektrodynamik“ lehnte er mit dem Argument ab, es verhindere die Anwendung der dritten Analogie der Erfahrung, da es den Verzicht auf den Begriff der Gleichzeitigkeit von Naturerscheinungen erzwinge. Eine kritische Nelson-Rezeption muss der Historizität etlicher Thesen Nelsons Rechnung tragen, aber zugleich die Bedeutsamkeit von Kernaussagen Nelson’scher Naturphilosophie im Hinblick auf die modernen Naturwissenschaften untersuchen. Das ist auch die Zielrichtung des vorliegenden Beitrages. Der erste Teil beleuchtet Nelsons wissenschaftliches Umfeld. Einerseits wird untersucht, welche Wissenschaftler Nelson beeinflussten, andererseits soll dargestellt werden, welcher Personenkreis an der Fortentwicklung der Nelson’schen Naturphilosophie beteiligt war. Beispielhaft sollen daran anschließend zwei Themenbereiche aus seinem reichhaltigen Werk disktiert werden, denen besonders im Hinblick auf aktuelle philosophische Diskussionsschwerpunkte Bedeutsamkeit zukommt. Im zweiten Teil werden nämlich Nelsons Betrachtungen zum Verhältnis von Freiheit und Naturnotwendigkeit sowie seine Unterscheidung zwischen wissenschaftlicher und ästhetischer Naturbetrachtung besprochen. Der Beitrag beansprucht nicht, die Rezeptionssgeschichte und den Inhalt von Nelsons Naturphilosophie sowie die aktuelle Bedeutsamkeit seiner Thesen im Detail darzustellen aufzuarbeiten. Vielmehr geht es darum, Ansätze für eine zeitgemäße Interpretation Rezeption aufzuzeigen und anhand von Beispielen zu erörtern. (shrink)

Sofern man die Existenz objektiver Erkenntnisse anerkennt, ist man mit der Frage nach den Bedingungen der Möglichkeit für diese Erkenntnisse konfrontiert. Der Grund muss in Voraussetzungen liegen, die selbst wiederum empirisch nicht zu rechtfertigen sind. Zwar verwerfen Popper und Carnap den Begriff des "synthetischen Urteils a priori", doch die Voraussetzung, dass es "in der Natur gesetzlich zugeht", räumen beide ein. Diese empirisch nicht zu rechtfertigende Prämisse ist ein synthetisches Urteil a priori. Gemäß Kant ist innerhalb der Klasse der Erkenntnisse a (...) priori zwischen reinen und nicht-reinen Erkenntnissen a priori zu unterscheiden. Es in vorliegender Arbeit argumentativ dafür plädiert, Naturgesetze als apriorische Erkenntnisse zu betrachten, die der Klasse der nicht-reinen synthetischen Urteile a priori zuzurechnen sind. Vor diesem Hintergrund kommt die Arbeit zu der Schlussthese: Ein empirischer (d. h. empirische Begriffe enthaltender) Satz (etwa ein Naturgesetz) kann über den (empirisch nicht einlösbaren, aber als Postulat durchaus sinnvollen) Anspruch auf allgemeine und notwendige Geltung verfügen und somit Bedingungen der Möglichkeit für objektive Erkenntnis formulieren. Doch sind für die Entdeckung empirischer Sätze mit Anspruch auf allgemeine und notwendige Geltung empirische Studien (etwa das physikalische Experiment) erforderlich. (shrink)

Dieser Aufsatz will zeigen, dass die Beiträge von Jakob Friedrich Fries (1773–1843) zur Psychiatrie leider (zu Unrecht) vergessen, aber überaus aktuell sind. Seine Überlegungen sowie die der Wissenschaftler, die ihm gefolgt sind, haben in den Darstellungen der Geschichte der Psychiatrie mehr Beachtung verdient.

Sektion Erkenntnistheorie, 29.09.2014, XXIII. Kongress der Deutschen Gesellschaft für Philosophie 2014 in Münster. -/- The problem of synthetic judgments touches upon the question whether philosophy is in fact capable of making independent truth statements. According to Kant, synthetic judgments formulate the conditions for the possibility of objectively valid knowledge a priori. As far as empirical attempts at reinterpretation of the aprioristic fall short of this ambition, Kant’s a priori goes deeper. This is because modern science strives towards objective knowledge, although (...) its statements are fundamentally fallible. The topic of synthetic a priori thus continues to be relevant. -/- This paper will show that, in order to be viable at all, a modernized version of transcendental philosophy must ‘depart from’ the concepts of “independence from empirics” and/or the “purity” of the aprioristic. Kant’s reflections on non-pure synthetic a priori knowledge already contain attempts at this. Furthermore, the aprioristic validity of knowledge does not exclude the possibility, that it can be discovered empirically. Fries and, subsequently, Nelson proceeded with this separation (initially ascribed to Reichenbach) between the contexts of validity and discovery of knowledge, pointing out that the a priori can indeed be discovered empirically, yet never be proven. -/- Currently, there are still a number of valid reasons for arguing that concepts from transcendental philosophy continue to be of fundamental importance for the modern sciences. However, it must not be neglected that, even within a modernized framework of transcendental philosophy various unsolved problems remain and/or are created (such as the unfeasibility of the aprioristic claim to general validity and necessity, the problem of drawing a clear boundary between the noumenal and phenomenal worlds). Moreover, the “beautiful structure” of the Kantian system, which constitutes much of its persuasive strength, is lost. (shrink)

According to the scientific ideal of modernity, the propositions of science are considered fundamentally fallible. On the other hand, science strives for objective knowledge. Kant saw in the apriori the precondition for objective knowledge. But with the new conception of science the apriori (if it is not to be only logic) has become problematic. With it, however, the objectivity of scientific knowledge is at stake. As long as one grants objectivity to scientific knowledge, the question of the apriori remains topical. (...) On the one hand, this volume wants to trace the historical roots as well as the different interpretations of the apriori, and on the other hand, it wants to ask for approaches for a contemporary reinterpretation of this basic concept. The complexity and the antinomic character of this concept make it difficult to grasp "time" more precisely. We encounter time as a form of perception in its deeply subjective aspect, as a biological rhythm, as a social phenomenon in the sense of a collective determination of time, but also as (...) a physical quantity. Einstein's theory of relativity revolutionized our ideas of space and time. His Special Theory of Relativity (1905) allows "travel into the future" through the effect of time dilation he predicted, and Einstein's theory of gravity allows for closed time lines as solutions to its equations (e.g., Gödel cosmos, anti-de Sitter cosmos). However, traveling in a time loop would immediately lead to a number of paradoxes (e.g., grandfather paradox, information paradox). Although, surprisingly, the basic laws of physics (apart from extremely rare and macroscopically non-appearing quantum mechanical effects) would not be violated in a time reversal, there seems to be a fundamental prohibition of traveling into the past in nature. Stephen Hawking claims: Philosophy is dead! Natural scientists use terms like 'natural law', 'matter', 'nature' and 'theories'. Often these terms are taken for granted without reflection. The task of philosophy of science as a metatheory of science is to clarify these terms. In doing so, philosophy of science is confronted with epistemological, ontological and metaphysical questions. But it also deals with questions such as "How do we define the boundaries between different scientific disciplines?" or "How do we distinguish science from (...) pseudoscience?". In addition, philosophy of science deals with ethical problems of modern technology, with methodological issues, with reconstructing the structure and development of scientific theories, and with exposing ideological paternalism of science. The optimistic conclusion is: Philosophy is not dead - but philosophers must discuss with scientists on an equal footing. (shrink)

Starting from the notion of the Ideal Feminine, this paper discusses the representation of trauma and the portrayal of women as open wounds in the designs of Alexander McQueen and John Galliano. Particularly, I explore how the McQueen’s Deadly Woman and Galliano’s Doll question the boundaries between mortality, sexuality and decay. By examining the relationship between fear, desire and disgust in the aesthetic representation of the wounded fashioned body, I argue that in their works disgust functions as an empowering emotion, (...) contributing to the perception of the aversive fashioned body as a feministic act. This study investigates the dynamics of brick-and-mortar versus click-and-mortar microbusinesses, focusing on the strengths, weaknesses, opportunities, and threats (SWOT) within the local context of Balayan. Ten purposively sampled microbusiness entrepreneurs were examined using the SWOT method. The findings underscore the significance of product assessment, communication, and customer experiences in cultivating trust. Sensory experiences and competitive pricing emerge as strengths, while challenges such as poor sales necessitate strategic interventions. External factors, particularly technological advancements, exert influence on the retail landscape. Key strategies (...) include competitive pricing, flexibility, and an understanding of customer behavior. The study highlights growth potential in tailored experiences but acknowledges the risks posed by e-commerce competition. Additionally, a SWOT strategic plan is developed to leverage internal and external strengths and opportunities while mitigating weaknesses and threats. (shrink)

The increasing use of opioid treatment agreements has prompted debate within the medical community about ethical challenges with respect to their implementation. The focus of debate is usually on the efficacy of OTAs at reducing opioid misuse, how OTAs may undermine trust between physicians and patients and the potential coercive nature of requiring patients to sign such agreements as a condition for receiving pain care. An important consideration missing from these conversations is the potential for racial bias in the current (...) way that OTAs are incorporated into clinical practice and in the amount of physician discretion that current opioid guidelines support. While the use of OTAs has become mandatory in some states for certain classes of patients, physicians are still afforded great leeway in how these OTAs are implemented in clinical practice and how their terms should be enforced. This paper uses the guidelines provided for OTA implementation by the states of Indiana and Pennsylvania as case studies in order to argue that giving physicians certain kinds of discretion may exacerbate racial health disparities. This problem cannot simply be addressed by minimising physician discretion in general, but rather by providing mechanisms to hold physicians accountable for how they treat patients on long-term opioid therapy to ensure that such treatment is equitable. Present neuropsychological theories are divided between the possible existence of “God-modules” hardwired in the brain, on one hand, and God as a construction of the brain’s incapacity to explain unknown and unidentified events. In Theravāda Buddhism there is no personal deity; one experiences the ultimate as impersonal. This paper discusses the concept of Dána or charity as the foundation of Indian Social life. Dána has been in vogue in India since the Vedic times, but it was codified by the smritis which prescribe do’s and don’ts of the life of the individual. Limiting its scope to Yagnavalkya smriti the paper analyses the significance of Dána as a regulative principle of accumulation of wealth.

Sa ganitong diwa, tinularan ng US ang kanilang ideang sekular gamit ang pagbabantayog o pagtatag ng monumento para kay Rizal upang maisingkaw rito ang pagkauhaw sa edukasyon ng mga Pilipono. Naging daan ang pangkalinangang subersyong ito para dominahin ng US ang larang na intelektwal sa Pilipinas gamit si Rizal bilang geopolitikal na pananagisag. Nilalayon ng papel na ito sa pangkalahatan na tayahin ang praktikang geopolitikal ng imperyalistang kapangyarihan. Si Jose Rizal ay inilalarawan bilang may estilong diplomatiko sa pakikipaglaban. Ito ay naging inspirasyon ng mga Indones sa pagpapaunlad ng kanilang diwang makabayan at pagsulong kanilang laban para sa kalayaan. At sa pagtatamo ng Indonesia ng kabansaan, si Rizal ay naging tampok sa kanilang diplomasya at pakikipag-ugnayan sa Pilipinas. Makikita rin sa iba’t ibang aspeto ang naging dulot na inspirasyon ni Rizal sa mga Indones. Ang mga pagtatampok namang ito ay sinikap ding mabigyang resiprokasyon ng mga Pilipino. Ang pagtingin (...) ng mga Indones kay Rizal, batay sa isinagawang pananaliksik, ay kinakitaan ng mga salik partikular ang pagtingin ni Tan Malaka kay Rizal, pagkabatid sa mga salitang Arabiko gayundin sa kaalaman sa pagsasalin. Ang mga salik na nabanggit, gayunpaman, ay inirerekomenda ng pagaaral na ito na magawan pa ng balidasyon sa mga mamamayang Indones partikular ang ukol sa tuwirang kinalaman, kalawakan ng kamalayan, at/o interpretasyon ng kanilang kapwa Indonesia kay Rizal at/o kanyang mga akda. Layunin ng komemoratibong pag-aaral na ito, gamit ang isang naratibong pagsusuri, ang pagturol sa danas at alaala ng mga Marikeño sa panahon ng pananalasa at/o pagbahang idinulot ng Ondoy (Ketsana) noong 2009 at sa mga panahong pagkatapos nito. Habang sentro ng pag-aaral na ito ang apat na barangay ng lungsod o ang mga tinatawag na “tabing-ilog”—Nangka, Tumana, Malanday, at Concepcion Uno—gumamit ang pananaliksik ng dalawang pangunahing método, pakikipagpanayam at pakikipagkuwentuhan. Sa kinasapitan, nakapagluwal ang pananaliksik na ito ng dalawang pangunahing bahagi: (...) una, mga naratibo ng danas at alaala sa panahon ng pananalasa ng Ondoy at ikalawa, pagsisiyasat sa mga sumunod na panahon. Sa kabuoan, nakapaglatag ang pag-aaral na ito ng pitong dalumat ukol sa kahulugan, kabuluhan, at konteksto ng Ondoy sa pananaw ng mga Marikeño: (1) delubyo, (2) kaparusahan, (3) kaligtasan, (4) pagtulong, (5) palatandaan, (6) takot, at (7) kasanayan. Hatid ng pag-aaral na ito ang isang implikasyong magpapahalaga sa dalawang bagay—(1) Araling at Kasaysayang Pangkapaligiran o isang subdisiplinang kakanlong sa pag-aaral ng kasaklawan ng kalikasan at kapaligirang Pilipino at (2) Kasaysayang Pampook o pagsasalaysay ng kasaysayan ukol sa isang partikular na pook. Samakatwid, ang kabuoang implikasyon ay magbibigay-linaw at ambag sa saysay ng Ondoy bílang bahagi ng kalikasan at kapaligirang Marikeño sa unang banda at ang saysay ng Marikina bílang pook sa kabilang banda. L’oubli de notre époque est marqué par une divulgation technologique dans le mode de l’arraisonnement (Gestell) où les étants se révèlent comme partie du fonds (Bestand) d’être calculés, manipulés, exploités, et mis en réserve pour un usage ultérieur. La phénoménologie féministe de l’A. essaie de faire sens à la gestation, la maternité et la procréation médicalement assistée (PMA) qui font aux femmes faire partie de ce fonds et ouvre, parmi les paramètres du Gestell, la porte à une ère « sans mère ».
